Terms of Use for the Code Academy Platform<\/b><\/p>\n

These terms are effective as of May 2, 2023.<\/span><\/p>\n

These General Terms and Conditions \ngovern the relationship between you, the visitors and users of the \nservices, on one hand, and the company \u201cOn Training\u201d Ltd., which \noperates the codeacademy.bg platform and its subdomain \ntrainings.codeacademy.bg \u2013 the merchant offering the services, on the \nother.<\/span><\/p>\n

The conditions described in this document apply to all directions, training programs, and courses offered by \u201cOn Training\u201d Ltd.<\/span><\/p>\n

Registration on the website and \naccess to our services require your agreement to these General Terms and\n Conditions. We kindly ask users to carefully review the contents of \nthese General Terms and Conditions before proceeding with registration \nand using the services provided by \u201cOn Training\u201d Ltd.<\/span><\/p>\n

The act of actively ticking the \nconsent box for these General Terms and Conditions in the designated \nlocation should be considered an ordinary electronic signature within \nthe meaning of Art. 13, para. 1 of the Electronic Document and \nElectronic Certification Services Act (EDECSA) and Art. 3, point 10 of \nRegulation (EU) No 910\/2014. By ticking the box, the parties expressly \nagree that the legal effect of the tick is equivalent to that of a \nhandwritten signature.<\/span><\/p>\n

Any changes to the General Terms and \nConditions will be duly reflected by updating the date at the top of the\n document, and users should be notified via the email addresses they \nprovided. If you do not agree with any part of our General Terms and \nConditions, please do not register on the website or use our services. \nBy continuing to use the site, we will consider these actions as your \nacknowledgment of and agreement to our General Terms and Conditions. If \nyou do not agree with certain changes to the General Terms and \nConditions or have questions related to them, please contact our team \nusing one of the following methods:<\/span><\/p>\n

For more information about users\u2019 \nrights regarding changes to the General Terms and Conditions, please \ncarefully read Art. VIII of these General Terms and Conditions \u2013 \n\u201cChanges to the terms.\u201d<\/span><\/p>\n

  1. Definitions<\/b><\/li><\/ol>\n

    \u201c<\/span>Merchant<\/b>,\u201d \u201c<\/span>Company<\/b>,\u201d or \u201c<\/span>we<\/b>\u201d\n refer to the legal entity \u201cOn Training\u201d Ltd., with Unified \nIdentification Code (EIK) 204154179, headquartered and managed in Sofia \n(capital city), Sofia Municipality, Sofia, P.O. Box 1164, Lozenets \nDistrict, Lozenets Residential Complex, 47 Dobri Voynikov Street, \nadministrator of the Codeacademy.bg website, which provides programming \ntraining courses as part of its commercial or professional activities.<\/span><\/p>\n

    \u201c<\/span>User(s)<\/b>,\u201d \u201c<\/span>Trainee(s)<\/b>,\u201d or \u201c<\/span>you<\/b>\u201d refer to natural persons who are registered on the website and enrolled in programming course(s).<\/span><\/p>\n

    1. Registration and Course Enrollment<\/b><\/li><\/ol>\n

      Before users are bound by the clauses\n of these General Terms and Conditions, the Company makes these General \nTerms and Conditions available to the Users.<\/span><\/p>\n

      For this purpose, a user profile must\n be created, which is registered on the website. It is necessary to \ncomplete a registration form, which includes:<\/span><\/p>\n

      \u2013 username, email address, phone number, and password;<\/span><\/p>\n

      \u2013 declaration of acknowledgement and \nconsent to the content of these General Terms and Conditions and the \nPrivacy Policy (Personal Data Policy) by ticking the respective \ncheckboxes.<\/span><\/p>\n

      The data described above are \nmandatory for registration purposes and for creating a trainee profile \nto access the Company\u2019s services in the training delivery system, hosted\n on the subdomain trainings.codecademy.bg.<\/span><\/p>\n

      The made public offer is considered \naccepted by the respective Trainee upon their enrollment in the \nrespective training course. The platform sends an email confirmation \nmessage for the Trainee\u2019s enrollment in the training, which email is \nsent to the Trainee\u2019s provided email address.<\/span><\/p>\n

      The clauses of these General Terms \nand Conditions constitute an integral part of the accepted public offer.\n Also integral are the tuition fee tariff for the Trainees, as well as \ninformation regarding the type, schedule of training, and the issuance \nof diplomas and certificates.<\/span><\/p>\n

      III. Tuition Fees<\/b><\/p>\n

      The tuition fees are specified for \neach of the offered courses. Tuition fees can be paid via bank transfer.\n When purchasing with a card, registration is required. \nTransactions\/payments on our platform are conducted in Bulgarian Lev \n(BGN).<\/span><\/p>\n

      The tuition fees are final and include value-added tax (VAT) and any other additional taxes and fees payable by the Trainee.<\/span><\/p>\n

      1. Payment Methods<\/b><\/li><\/ol>\n

        After registering on \ntrainings.codeacademy.bg as a Trainee and selecting the desired \ntraining, the Trainee is redirected to a shopping cart with the selected\n product added and must choose one of the following payment methods:<\/span><\/p>\n

        \u2013 <\/span>Bank transfer <\/b>\u2013\n when selecting this method, the Trainee must make a bank transfer to \nAllianz Bank Bulgaria, IBAN: BG09BUIN95611000551952, BIC: BUINBGSF, \npayment reference: Name of the chosen training.<\/span><\/p>\n

        \u2013 <\/span>Credit\/debit card payment <\/b>\u2013\n when choosing payment by credit\/debit card, a payment page will open \nwhere you enter your card details \u2013 card type, card number, expiration \ndate, and CVV2\/CVC2 code \u2013 the last three digits of the number, printed \nin the signature field on the card. If you are registered with the \nVerified by VISA or MasterCard SecureCode authentication schemes, an \nauthentication page will open where you enter your authentication \npassword. Upon successful transaction (authorization received), a \ntransaction note is displayed on the screen, which you can print or \nsave. We accept the following types of cards: MasterCard, MasterCard \nElectronic, Maestro, Visa, Visa Electron, V Please note that your V PAY \nor MasterCard Electronic card will be accepted only if it is registered \nto participate in the Verified by Visa or MasterCard SecureCode online \nauthentication schemes. When paying by card, the funds are withheld at \nthe time of the \u201cPurchase\u201d transaction \u2013 immediately.<\/span><\/p>\n

        To protect you from misuse when \npaying with your Visa or MasterCard card, we apply the best practices \nrecommended by international card organizations:<\/span><\/p>\n

        \u2013 Security when entering and \ntransmitting card data is provided by using SSL protocol to encrypt the \nconnection between our server and the payment page of our servicing \nbank.<\/span><\/p>\n

        \u2013 The authenticity of your card is verified by entering the security code (CVV2).<\/span><\/p>\n

        \u2013 Additionally, for your \nidentification as a cardholder, the electronic commerce payment server \nof our servicing bank supports the authentication schemes of \ninternational card organizations Verified by VISA and MasterCard \nSecureCode, in case you are registered to use them.<\/span><\/p>\n

        1. Assessment and Certification<\/b><\/li><\/ol>\n

          A certificate is issued upon completion of an individual module.<\/span><\/p>\n

          For the Java Jumpstart module, a \ncertificate is obtained upon payment of the fee after the Trainee has \ncompleted all lessons and tests in the system.<\/span><\/p>\n

          For the Unlock Java and Java WEB \nBack-end modules, a certificate is issued upon successful completion of \nthe final exam. Successful completion means achieving a minimum score of\n 70%.<\/span><\/p>\n

          1. Intellectual Property Rights<\/b><\/li><\/ol>\n

            During the training at Code Academy, \nthe Trainee has access to various materials, including written texts, \naudio and video content, graphic images, photographs, diagrams, \nsketches, source codes, trademarks, and similar. These materials are \nprotected objects of intellectual property under Bulgarian law. For this\n reason, the Trainee may use the provided materials solely for \nnon-commercial and personal purposes, namely for their training.<\/span><\/p>\n

            In connection with the protection of \nthe aforementioned objects of intellectual property, the Trainee has no \nright to display, advertise, reproduce, use, store, translate, modify, \npublicly present, and\/or copy, in whole or in part, the provided \nmaterials, on their own behalf or on behalf of others.<\/span><\/p>\n

            VII. Right of Withdrawal<\/b><\/p>\n

            The Trainee has the right to withdraw\n from the training course before starting it and commencing the training\n within a 14-day period from the date of payment registration. Started \ntraining means that at least 1 lesson of it has been completed. The \ntransaction between the parties is considered concluded from the moment \nthe Company sends an email confirmation of the Trainee\u2019s enrollment in \nthe training course, which email is sent to the Trainee\u2019s specified \nemail address.<\/span><\/p>\n

            When the Trainee wishes to withdraw \nfrom the training, they inform about their decision before the \nexpiration of the aforementioned 14-day period. The User has exercised \ntheir right of withdrawal if they have sent a message exercising their \nright of withdrawal before the expiry of the 14-day period, and the \nmessage should be sent through the official communication channels \nspecified in these General Terms and Conditions.<\/span><\/p>\n

            Upon receiving the message exercising\n the right of withdrawal from the Company, the latter sends the User a \nconfirmation of receipt of the withdrawal to the email address provided \nby the Trainee for correspondence.<\/span><\/p>\n

            Exercising the right of withdrawal \nterminates the obligations undertaken by the parties in connection with \nthe respective training course.<\/span><\/p>\n

            Upon receiving the confirmation, the \namount will be refunded to the Trainee through the channel used for \npayment \u2013 via bank transfer. If there is a need to refund amounts paid \nby card for agreed and performed services, we will do so via bank \ntransfer within a specified period.<\/span><\/p>\n

            The respective Trainee can expect the\n refund to be made without undue delay and no later than 14 days from \nthe date on which the Company was informed of the User\u2019s decision to \nwithdraw from the contract.<\/span><\/p>\n

            VIII. Changes to the Terms and Conditions<\/b><\/p>\n

            The Company reserves the right to amend or replace these General Terms and Conditions.<\/span><\/p>\n

            In the event of a change to these \nGeneral Terms and Conditions, the Company will notify all Trainees \nwithin a 7-day period from the occurrence of this circumstance, with \nnotifications sent to the email addresses provided by the Trainees.<\/span><\/p>\n

            The amended General Terms and \nConditions enter into force and bind the Trainee when the Trainee is \nnotified of the change at the email address provided by them.<\/span><\/p>\n

            1. Exclusion from Code Academy<\/b><\/li><\/ol>\n

              \u201cOn Training\u201d Ltd reserves the right \nto unilaterally and immediately terminate the training of a Trainee by \nexcluding them from attending classes and accessing the Learning \nManagement System if they:<\/span><\/p>\n

              \u2013 Engage in activities unrelated to the course material during the lecture;<\/span><\/p>\n

              \u2013 Disrupt the learning process with their behavior and interfere with the lecturer and other trainees;<\/span><\/p>\n

              \u2013 Display aggressive or unacceptable behavior before, during, or after lectures;<\/span><\/p>\n

              \u2013 Fail to comply with the rules and conditions to which they have agreed.<\/span><\/p>\n

              If, after a demonstration of the \nabove-mentioned behaviors and situations, and after verbal warning and \nwritten notification via email, the Trainee does not change their \nbehavior, they will be removed from the learning process. Removal from \nthe learning process entails terminating the participant\u2019s access to the\n Learning Management Systems. In the event of termination of training \ndue to the aforementioned assumptions, the parties agree that the \nCompany will retain the training fees commensurate with the training \nconducted, and if there are amounts to be refunded to the Trainee, they \nwill be refunded.<\/span><\/p>\n

              1. User Complaints and Reports<\/b><\/li><\/ol>\n

                As users within the meaning of the \nConsumer Protection Act and in case of violation of their rights, \nTrainees have the right to submit complaints, reports, and suggestions \nto the Consumer Protection Commission in writing on paper or \nelectronically.<\/span><\/p>\n

                1. Correspondence<\/b><\/li><\/ol>\n

                  All notices and other communications \nregarding the training of the Trainees and\/or the relationship between \nthe parties should be in writing and transmitted via registered mail or \nmail with acknowledgment of receipt, express mail, or other express or \ncourier deliveries, or electronically to the addresses provided by the \nparties.<\/span><\/p>\n

                  XII. Final Provisions<\/b><\/p>\n

                  All disputes between the Company and \nthe Trainees shall be resolved through negotiations and in a friendly \nmanner between the parties. In case the parties fail to reach a mutually\n acceptable agreement, all disputes arising from these General Terms and\n Conditions, the terms of training, the transaction between the parties,\n or related thereto, including disputes arising from or related to \ninterpretation, invalidity, performance, or termination, as well as \ndisputes regarding the filling of gaps or adaptation to new \ncircumstances, shall be settled by the General Reconciliation Committee \nat the Consumer Protection Commission.<\/span><\/p>\n

                  To exclude any disputes, the parties \nagree that the correspondence exchanged between them in electronic \nformat shall be recognized as official written evidence.<\/span><\/p>\n

                  The invalidity of individual clauses \nof these General Terms and Conditions shall not lead to the invalidity \nof the entire General Terms and Conditions.<\/span><\/p>\n

                  If any of the clauses of these \nGeneral Terms and Conditions are deemed to be unequal clauses, it is not\n binding on the user, but the General Terms and Conditions as a whole \ncontinue to apply to the parties under the remaining conditions, where \nthey can be fulfilled without the unequal clauses.<\/span><\/p>\n
